Turns out Nintendo customer service can't switch over NNIDs to a new console, it is completely locked, and they're looking into what they can do but are not optimistic that anything can be done.

And they can not even transfer your content to another console.

 

So officially you are screwed if you buy games from the e-shop.

Funny because I'm being told otherwise.  Not sure if you've noticed it yet but when I say something is coming or is in the works, it tends to happen. 

The problem with asking customer service if they can fix it is because their customer service department is outsourced to Golin Harris.  You're not actually talking to Nintendo so those reps generally have no idea until Nintendo sends them the new policy details.
