I should think so. Alcohol is legal but you can't show up for work drunk.

@OT, this is pretty cool. I support legalization but it's not a major issue for me. I don't smoke.

I'm not saying show up to work high. 

What I mean is some places do urine/hair tests to see if you have smoked in the last few days/weeks.  Could employers still deny employment if you don't pass a test saying you have done a legal drug a few weeks ago?
