You'll have to define "very likely", but I don't see any evidence that DUI laws actually prevent anyone from doing it. All it really does is give cops yet another excuse to harass people, and it's a racket for making money off of people who are minimally impaired (if that) and were only "caught" because of a roadblock.  Reckless drivers ought to be punished whether they are sober or not.
