I'm not at all sure that it is unconstitutional, actually, and calling it retrofitting seems pretty ignorant since same-sex marriage has never been sanctioned by Western civilization except for a relatively few instances in ancient Rome before they outlawed it.
Violating actual civil rights in a symbolic show of support for civil rights is the very height of hypocrisy. Particularly from the likes of Rahm Emanuel, who served as chief of staff for a guy who not so very long ago professed to share Dan Cathy's view on gay marriage.
