the gopvernment did not take the servers.
The servers are still in the hands of the original owner.
Megaupload was leasing or renting the servers it sounds like and no longer has the money to do so since his assets are frozen.
So the only course of action for users would be to contact the owner of the servers or sue the company they were dealing with, megaupload.
The files are not lost, they just dont have access to them.
That is my understandning unless i read it all wrong.

So, if the government illegally freeze all your assets, making you unable to pay for your mortgage. The bank then take your properties and who would be at fault?

they froze the owner of megauploads assets. not the people who can not gain access to their files.
I was not saying what they did was right or wrong, it just seemed like he had the wrong idea of how it went down. The government didn't take anyhting as far as i know. Its a case of Dotcom (is that his name?) not being able to pay to rent the servers for his business any more. Unless I am reading it wrong.
