This has nothing to do with MS or whatever.
Look at the patentwars going on. These lawsuits are not because highly technical patents, more because of really basic patents. Do you really think a company like MS with a legal division bigger than most other companies "forgot" something for one of their key devices? And now the new company will step up and outperform MS. Right...
Not gonna happen.
And for the bolded part: What did you expect them to say? The network MS has with their whole ecosystem is gigantic. Developers, hardware manufacturers, publisher, retailer, marketing people, their own devices, cross platform from Windows to Windows phone to Xbox Live etc. etc. This is where a lot of good ideas simply fail. If this is a good thing or not is a different question.
