I think we need to redefine precisely what we're talking about. The soundness of Viper's argument depends on exactly what he means, because i can see how he would be right, or wrong.
If we say "downloads will be tied to the hardware they are purchased on, regardless of the Nintendo Network account," then we can comfortably say this won't be the case.
