So what you are asking is if you break 3 Wii U's will you still be able to redownload your games to a 4th Wii U?
And your situation is still not a matter of software being tied to hardware, it's a matter of a limited number of licenses. Tied to hardware means the game is downloaded to a hardware account. Like a friend code. It's locked to that one piece of hardware. Like with the Wii's WiiWare service. You download a game with no user account associated with that game. Even the friends code system has 2 levels. A system friend code and an individual game friend code so a downloaded game is linked with the hardware, not a user account. Thankfully the 3DS reduced that to just a single system friend code and can be linked to your Club Nintendo account. Because Wii U will have user accounts, sofware will be associated with the user account that downloads it.
So it seems you're confusing licensing allotments with software tied to a user account.
