The 3DS eShop would be the first indicator. It hasn't corrected all of the problems (I feel poor organisation remains a problem), but there has been a lot of improvement. More demos, notification of new content, and then there was the then denied suggestion of a 2GB file size limit, bit nobody has hinted at what it actually is.
They've taken too many steps forward to go back to the Wii setup.
