Pretty positive Apple would charge royalties and a licensing fee. I don't think this would be much of an issue. As for games Nintendo embraced Flash years ago during the GameCube era I remember Nintendo releasing promotional Flash games to promote games like Jungle Beat and Mario Sunshine. I see what Activision did with Prototype releasing a free game to promote the console game over iOS. If Nintendo released 3-4 level long small mobile games available free with registration of a Nintendo game it would be brilliant. If Nintendo couldn't limit the miniature mobile games then Nintendo could put up free games (20-minute campaigns) 3-4 levels with commercials. Maybe you beat the Donkey Kong mobile game at the end it sends you to the order page to buy the full game downloadable over Nintendo's network through the My Nintendo App.

Nintendo should definitely not make any actual games for mobile devices or social media. But Nintendo should not ignore them. They are great advertising tools and Nintendo knew that during the GCN era. Nintendo embraced Flash and it likely paid off.

Nintendo could open Nintendo mobile, a 25-man studio that produces small promotional mobile or social games. A single employee could make an iOS game in 6-months or less. Meaning Nintendo could release dozens of commercial promo mobile games. All of which would promote and help Nintendo sell software. By linking them to registrations of actual full price retail games Nintendo could make a fortune. Mobile and social mini promotional games could help Nintendo sell bucket loads.
