The hardware is capable of it. The DS is programmed to recieve and execute arbitrary software from another "DS", so the 3DS has to pretend it's a DS and then send a modified program, but I don't see how it's impossible.
The reason why it would be a good business strategy is that 3DSs are rare, people don't know other people with a 3DS. But they do have DSs. So multiplayer games on the 3DS would appeal to more people if they knew that they could be played using one 3DS. It won't happen but I'm saying that is my condition for buying this thing, because I'm sure not going to buy a second 3DS just for this game.

I still don't think you understand. When playing multiplayer using one DS card the host sends out a signal that other DS's copies. The other DS's then have saved copies of demo versions of the game on its memory (which gets deleted once you turn the system off). Each DS has its own copy of the game and does its own processing. And since a DS is incapable of playing 3DS games due to hardware limitations, it can't play demo version of 3DS games either.
It's a silly business strategy since it won't make more people buy the 3DS to play with their friends which means less hardware sales, pretty simple actually. And no one expects to be able to play Xbox 360 games on an Xbox for instance (which tells how ridiculous this discussion really is).

The full copy of the game is not transmitted. Sure, for most games, a kind of cut down "demo version" game is transmitted, but that's not required, it will accept ANYTHING, you just need to send a streamer program as I said. Look at the Game Boy link cable, I doubt even anything was transmitted, it was just using the second one as a screen and buttons.
For a 360 you can plug in two controllers. Think of this as plugging a second controller into the 3DS, except that controller is a DS you already own.
