well they are not rip-offs by any means. on N64 Mario stepped into the 3D world with Mario sunshine, and i think Spyro the dragon and Crash were on PS1.
then came R&C, and J&D on PS2 with another Mario game in the same vain, but since the creators of each franchise were already creating games in a 3D world you really couldn't say either is a rip-off, unless you look at it in the fact that R&C takes place on many different worlds, or planets.
if you look at it like that, then Mario Galaxy could be looked at as a rip-off.
