Independent developers can do whatever they want with it, and that's the reason Sony is not even updating it anymore; they gave up.
By releasing a homebrew app capable of emulate the UMD drive to trick this service, pirates would be obtaining a license for a game they don't even have for about 5 or 10 bucks, upsetting publishers.
There's a different situation in Japan, where PSP software sold pretty well and piracy is significantly lower.
When asked about this, Yoshida answered with bullshit because he couldn't say what he was actually thinking: "Because Occident is full of dirty pirates!".
