Microsoft don't want to be a publisher of a game that is published first by Sony. But the game developer can publish the game with a third party publisher like EA, THQ etc. That's all.

 

On XBLA Microsoft acts as a publisher only for games that are exclusive or timed exclusive for XBLA. For example - Sine Mora, was multiplatform but when the developer decided that Microsoft will be a publisher for the game, the PSS one was canned and Sine More will be at least timed exclusive for XBLA like LIMBO, Castle Crasher etc.

 

SW developers are just stupid that they don't understand it after 6 years of X360 on the market.

Microsoft has to greenlight every XBLA release and they reserve the right to refuse to allow games released first on other platforms to be published. Now that is bad for the industry, though it generally makes sense (and the implementation of this policy was generally to counter SONY's "Pub Fund" policy where SONY helped fund development for indie PSN titles provided that the game was released on PSN first)
