mine came with the update.i have been tracking 5.1,apple keeps pushing it.

yours is black or white as blacks are supposed to have terrible battery issues

 

my speakers are great but headphone bass and volume seems to be low.also the heaphones just don't fit properly and keeps coming off.

my earlier 3GS had great bass and volume,it was almost like noise canceling.

if you have other apple products please check the audio

 

 

as for battery i am not talking about iphone 4 vs 4s comparision but apple's recommendation of 10 hours of  video and 9 hours of web browsing.

Make sure you don't have any lint stuck in the headphone jack, you might have something in there that is preventing your headphones connector to make physical contact with the jack while also pushing it out of the jack hole. This is a very common issue, use a regular sewing needle to remove anything in there and you should be good to go.
