No way warranty will cover it, even if it's a design flaw, some 360s had a design flaw where even slight vibrations would make the disc drive scratch disks (it wasn't properly aligned) and nothing came of that. That said given how much trouble Nintendo is in right now if you call them in a fury and vow never to buy any Nintendo products again they may fix it for free to keep you as a customer.
