That's old news that had been already discuss here.
This is just in their EULA to cover their ass if your console get brick when you update because of none compatible equipement (flash card) or custom firmware. The funny things is that this line also been on the Wii EULA, and when did Nintendo intentionaly brick modded Wii?
But we must first concentrate ourselves on the way to entertain people, for video games to live. Else, it's a world where sales representative will win, which has as effect to kill creativity. I want to say to the creators all around the world:"Courage, Dare!". Shigeru Miyamoto.
