Mass Effect 1 had frame rate issues, texture pop in, and long load times. Most 3rd party developers first game using UE3 had the some issues. It was not isolated to Silicon Knights. I'm not saying SK couldn't be exaggerating the situation but there were clearly problems with UE3, on 360 and PS3 in particular, at the start of this generation.
