If Bin Laden wasn't dead, he could now very easily embarass the US government by simply releasing a video of him with today's newspapers, discussing his "death". Certainly Obama isn't stupid enough to risk that.
So I'm pretty sure Bin Laden is dead. At most conspiracy theorists could doubt the date and cause of his death...
edit - or I guess you could say he was otherwise captured or severely incapacitated. That is possible, though it also seems risky to lie about it.
