It would, but that isn't the point of the case.

The point is for Sony to be found in breach of consumer rights laws and for a precedent to be set.

It also sends out a message that big companies aren't above the law.

This decision is a precedent. Anyway the point of the case is to have the legit users of Linux get compensated, that is whats important.
