I think its linked with the model/brand of modem/router you use. I think the Update was supposed to fix that but only worked for a majority of products.
Its odd Nintendo has not picked up on this and is simply handing out
new 3DS's though..
I haven't got my Repair Email reply from Nintendo I sent monday. Since its my second
request they may be scratching there heads.
Its really weird that this would be causing a system Error, the kind
that indicates the System is broken and needs a replacement.
Will be intresting to see what happens.
