How and why? It's not illegal, and i don't think Tesco cares who they sell their consoles to as long as they sell.

i can even see a bit of an advantage, as Tesco surely won't be bothered with warranty issues if any of these fail

Well, I reckon Tesco will be selling this as a "loss leader" (I think that is the term) where they sell at a loss to bring consumers in to buy other items

Indeed, supermarkets have done it before with consoles. If Tesco make any sort of loss on the 3DS or even break even, it's pointless them actually selling them to the people who are just going to sell them on. Tesco should just raise the price.
