that could, its at their decision to do it or not. they can throw you in jail for no reason if they want and make up a charge. it has happened many times. dear god, my sister is currently facing DUI charges even though she didn't drink anything and just "smelled like cigarettes and alcohol." Guess what? she is a bartender, what else would she smell like? fresh roses and chocolate? There is no legal proof. She did not blow. They did not do a blood test or anything to see if she was really drunk or not. No sobriety test either. Just handcuffed and jailed.
The USA has become a police state where all cops have a quota they need to hit on number of arrests. They tell you they don't have one, but I do know a few cops and they will tell you they do. If they don't hit that quota they won't get a bonus and have their hours cut for the next month. The law has gone out the window thanks to rules like "cops can't have an IQ past 105" and that some stations refuse to let officers question orders with fear of termination. It's corrupt politics like mostly everything else in the Corporation of the USA.
