Nintendo isn't that dumb to brick system on purpose.
Even if they can prove someone using the flash cart. They would have to prove that it was piracy and not homebrew or whatever.
After that, the case will be about the "act of piracy", which leaves Nintendo no ground for bricking a system.
An eye for an eye, everybody will go blind.
