Yeah, it makes too many people angry, even though it is entirely true.

Again, just as clarification, calling a statistical tie what it is will not cause a ban. What will be are the people who are flaming others going either way on a victory vs tie argument.

So if we use the term each time the sales are within the margin of error (I believe this site stated ~10%) regardless of the console it is perfectly alright?

For example the 360 is ahead this week by 5k, so I say "Statistical tie" and next week the PS3 is ahead by 5k and I say "Statistical tie" I am in the clear regardless of whether or not it causes people to complain?

This is correct. It is a factual statement, and is not in violation of any rules. If the complainers start attacking, then they will be seen as flaming a user.
