That certainly wouldn't be the case, at least as far as device-to-device communications go. Of course it depends on how active Street Pass actually is, but outside of Japan, how many people are you going to pass on the street with 3DS' running in their pockets? (which raises a whole other can of worms, that Nintendo's touting a feature that's going to be next to worthless in most of the major markets)
