Yeah it does. It's really confusing, though. As long as I can get more than 5 hours with 3D turned on but Wifi off and medium brightness I'm happy 
You don't need wifi on the go and turning down brightness shouldn't be a problem.
But after all those comments by Nintendo ("charge it more frequently") and the not-so-announcement of a price for Europe I was afraid things would turn out badly. But now we've got improved online, a somewhat reasonable price and better than expected battery life. Yay
