Actually, you can redownload your games for free.

it's tied to the cosole though not to you.  if you wanted to upgrade to a newer model or replace one with a impending hardware failure you are SoL and loose all of your games.  360 and ps3 have ways to transfer your info should you choose to upgrade your hardware.

Like Rainbird said, call Nintendo.  Not a fun step to take but it works.  Also helps to have your collection registered with Nintendo.   I'm not saying it's a good system or that they shouldn't go to a universal log in system but saying you can't transfer your games is false.

the terms of your agreement when purchasing a game on wii ware or the virtual console is tied to the machine not the user.  yes, there have been cases where calling nintendo you can convience them to bend the rules but nintendo can and has said no to customers as well.

a system that requires you to call and plead for them to make an exception is not a system.
