Man if I was Nintendo I'd be pissed. Unless maybe Nintendo is allowing this to happen to strengthen their relationship with Square.
Its basically like Square said to themselves "You know what would be great? A Final Fantasy sports game. Hmm nobody will go for that, but if we put Mario and friends on the cover and in the game it will sell shit loads and increase brand awareness for FF".
Then they approached Nintendo with their idea, and Nintendo let them whore out Mario alittle to help boost their relationship with Square.
