It would only be an infringement on consumer rights if it reduces prodeuct capability.   Otherwise, it is seen as a measure of product maintenance and part of the EULA of the operating system in the 3DS.

 

Happy, proprietary OS's  are insanely difficult to write a virus for.  Look at how many non Windows PC devices communicate with each other and you never hear of them getting a virus.  There are also numerous ways to verifying the code is clean before the 3DS installs anything received from another 3DS.

I'm not saying it would be easy to write a virus that operated that way, just that it is a "feature" that could be exploited with very negative effects.
