I doubt Nintendo will produce a system without a system that limits the ability for strangers to communicate with each-other for safety reasons; and as long as this is managed on a level which prevents people from having people share friend codes for every game it really isn’t that bad. Even with game specific friend codes, as long as there is a way to painlessly share these friend codes (possibly through integration with social networking sites) it would be a functional system.
Some things could be managed through parental controls, and if you could make it possible to allow people to communicate directly with other individuals or trade friend-codes in game with the proper settings; and then Nintendo would at least be able to protect their image by saying that people had to open up their privacy and security before they were able to get harassed by strangers.
