Dont know if DS will outsell it, it depends how big the Drop off will be after 3DS launched PS2 is about 15 Million ahead. So it can be reached pretty quick. Sony cant say we sold xxx Million PS2 when in reality they sold less. Thats illegal and there are rules what can be count and what not you can count a device which was replaced but only if the Customer paid for it atleast the production costs. |

VGChartz numbers are correct. Those regions which aren't tracked are still estimated so that is nonsense
As for it being illegal - how could it possibly be illegal to say "We manufactureed x copies of this hardware"? Certainly, if they said "retailers have sold x many of this hardware to consumers" then it would be a crime (Only if it was done in an investor statement btw, you can say pretty much what you want in media brieifings)
As for actual evidence - That's like claiming that gravity acts up and demanding I go out of my way to prove you wrong. Do your own research. I would try looking at Sony financial statements before April 2007 :)
