I have some ideas about how avoiding patent lawsuits: Sony and MS could use two pan balance scale-like devices, even hanging from the ceiling, just to get a more different feel, prior art dates back to some millennia ago. 
The only drawback is that this would pave the way to 3rd party clones, Sony could take it easy, but MS would be utterly pissed about not being able to milk royalties from them.
