Of course it's cool to talk about the future console, but Nintendo is not taking a proactive rule in this. What about the Wii and DS? Why not have proactive firmware updates to deter CURRENT piracy issue?

The trouble is that there are a lot of people who are NEVER online which is around around 50% of the DS or Wii users, according to some studies (even about 30% of the 360 and PS3 owners have not connected their consoles to internet). And even for those who doesn't have current firmware all games should work so it is difficult to force firmware updates. The only way to provide proactive firmware updates would be to deliver them with games. Which would mean mean old games would be easy to pirate so even that would not stop pirating.
