buying anything used on ebay will usually save you money. they are legit and if they are not ebay has buyer protection.
the difference is that people start bidding at low prices. by the final day a used DS that sells at gamestop for say $100 could sell on ebay for maybe $70
the idea of selling games and consoles on ebay is much better than selling back to gamestop because they are a ripoff 99% of the time. for example i could trade in final fantasy XIII now and get $29 trade in credit or i could sell used on ebay and probably get $38-$45 for it
