It was more than that, BBC legally can't offer the iPlayer on a subscription only service.
That's Microsoft's problem with Gold, holding up stuff like Netflix or Facebook or whatever hostage. I'm not sure how, but only Japanese MMOs seem to be getting around it too (FFXI, PSU, MHFO... and soon FFXIV).

They get around it by not using Xbox Live at all. FFXI forces you to install something called PlayOnline, which it uses to connect to the other platforms. You may notice it's one of the very few 360 games not to have Achievements, and that is the reason.
