if a game has use of an accelerometer it can be done. It's not really true 3d, but it's programmed to display 3d. There is a slight difference, but I think all of them are 3d capable.
It is strange though why Nintendo would go so far as to call it the 3DS (LADYLOO), because that sort of implies that the basis for the system is 3d...but the accelerometer based 3d is kind of a trick 3d. It's possible that they may do the dual-layered screen 3d tech that have been suggested.
