You're being paranoid.
1. The current PS3 hack is only doable when you're at the PS3 and hacking it. It can't be hacked remotely.
2. There is a light on the PS Eye that lights up when the camera is on.
3. What would Sony possibly gain from spying on their costumers? (As Sony are the only ones with the capabilities to actually do that)
4. If you're so worried, just disconnect the PS Eye when you take your PS3 online. Problem solved.
