if you're an expert on the matter, get off the board, contact Nintendo and tell them they clearly have an infringement case and you want to take it to court on their behalf. you ask the question about the situation, inherently meaning you don't know why it isn't infringement, and then behave as if you actually have the answers to the situation you know nothing about. if there was a case, Nintendo would make it, and I am willing to be that Nintendo and its teams of lawyers are not only more knowledgeable in this matter than you but smarter overall, so you haven't not only identified some glaring infringement but probably aren't even capable of doing so.
