because nintendo doesnt own those patents. you have to look back in the year 2000 when a midway employee did a prototype for a wireless motion controller like the wii-mote and patent it. midway sold those patents (rumored to nintendo). but even before that, motion controlls existed so nintendo doesnt own those patents and to be frank the ps3 arc looks nothing like the wii-mote and in fact is much better improved
