Are you talking about the DSiWare? All retail games are capable of being played in any region's DS as far as I know. I have a few Japanese and European imports, and they all worked with no trouble whatsoever.

And what about Wii games, and the ability to stream games from one cart (DS) or HDD (wii)?

that's a reason i have homebrew channel on my Wii, now there was no need to wait 1 year for Tales of Symphonia and Soul Calibur Legends, i got them from ebay and played them through Gecko OS on homebrew channel
if Nintendo does not want Homebrew on Wii, they have to make Wii region-free through an update or make future Wii's region-free
as for the Ds flash karts and HDD for Wii, they are 100% legit as long as you own the games
