I don't do homebrew and i definitely don't pirate, but i agree with the ruling.
As soon as I go into a store and buy a product, it becomes MY property. It is no longer the property of the retailer nor the manufacturer, so they should have no authority trying to dictate what I can and cannot do with MY DS (as long as its legal).
Instead of wasting money bringing this to court or trying to appeal this ruling, they should spend the money on R&D to make the DS2 and Wii2 unpirateable.
