This will get overturned..otherwise you can kiss handheld and console gaming goodbye. The console manufacturers make their money from licensing..if the system is totally open there is no need for licensing thus no profit for the console manufacturer. So far Nintendo is the only console in recent generations to actually make even a marginal profit off the consoles themselves within the first couple years of its launch. Without the current revenue path there can only be two options...no more consoles or at best no more subsidized hardware costs...which would mean drastically more expensive consoles, either of which would essentially kill the business as consumers are highly unlikely to spend $1000+ on a console...that may sound like an absurd amount but remember when the PS3 launched the parts breakdown determined it cost nearly $800 to build.
