To blame the developer over the cheater is asinine.

People aren't banned for cheating, or for letting their sexual preference known, they are suspended. Further, displaying your sexual preference is against the terms of service. If someone chooses to go against the terms of service, whether intentionally or through ignorance, is their own choice, but it's still against the rules.
