Two possibilities:

1) There's some loophole in the contract which they're thinking of exploiting.

2) If they just said "NO PS3 VERSION", then there would be one set of articles, and nothing else. If they keep it mysterious, there are articles every time they drop a hint. It gets the game more coverage.

Well I would assume M$ would have a proper arrangement in place, and if they did exploit a loophole, that might damage their relationship with M$

They don't need more coverage, they are a huge name and Mass Effect 2 is going to sell very nicely
