To be honest hacking into a top secret military computer is no small task. Hell, I bet he broke into one of the most secure systems in the world. If he goes to jail I bet the US government would have a job or two for him to do. I bet you will see him working with the government throughout his life, despite serving a prison sentence.
Kind of like how people who forge documents and money sometimes end up working with the government to tell them how to spot forged documents and money.
It would be a waste if they just kept him in a prison cell or mental institution.
