I believe the lawsuit isn't about piracy or banning at all.
It's about RETURNING the funds that banned console still have.
Frankly, I think if Microsoft were to ban people for violation of "terms of agreement", themselves should refund the remaining months of fee already paid.
That's what Accounting is about, You can't kick someone out and keep their unaccord expenses
