Correct, and Nintendo won the lawsuit. That's why the nunchuk that Nyko eventually released looks like this, when it was originally supposed to look like this. I believe there are  a few units of the original model in the wild (which I've always wanted to get my hands on), but the majority are going to be the...less attractive version.

Nintendo and Nyko settled the lawsuit under the agreement that Nyko will be allowed to sell a redesigned version of the remote. This could mean that Nintendo let Nyko apply for a license to sell a Nunchuk clone. This may not happen for Sony.
