That was Just a rumor. Nintendo nor Rare owns the rights to GoldenEye. Therefore if the game was going to be ported to the XBLA there is nothing Nintendo could do about it.

Nintendo owns the rights to some aspect of the game, like the code or something like that.  Basically everyone's in a gridlock.

As near as I can tell, Nintendo and Rare (as Nintendo second-party) co-developed the N64 classic and shared some rights to it. But without the Activision-owned Bond license, neither can take any action -- independently or combined.

Also, Activision has publically blamed Nintendo for the deadlock.
