It's possible, unlike American companies (or American branches of Japanese companies) the parties involved are more likely to let others use similar ideas without suing the hell out of them.

On a side note From Software has really impressed me this generation, I really enjoyed Ninja Blade (one of the few games I say don't listen to reviews cause they're simply wrong, its not Ninja Gaiden light its God of Wa.. I mean Ninja) I played Demon Souls yesterday and it was brutal, hard, pissed me off, and I loved it the first really hard action rpg I've played this gen.  And now 3D Dot Game Heroes could be just as awesome.
